These Terms of Service ("Terms") govern your access to and use of the CyberPolicify website, platform, and services (collectively, the "Services") provided by CyberPolicify Inc. ("CyberPolicify," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that you are at least 18 years old, have the authority to enter into these Terms on behalf of yourself or your organization, and agree to comply with all applicable laws and regulations.

2. Description of Services

CyberPolicify provides AI-powered compliance and security policy management tools, including:

  • Gap analysis assessments for compliance frameworks (SOC 2, ISO 27001, NIST, etc.)
  • AI-generated security policy documents
  • Risk register and remediation tracking
  • Compliance readiness reporting
  • Organization security context management

3. Account Registration

To use certain features of our Services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

4. Subscription Plans and Payment

4.1 Plans

We offer various subscription plans including Trial, Core, and Professional tiers. Plan features and pricing are described on our pricing page and may change with notice.

4.2 Payment

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • Payments are processed securely through Stripe
  • All fees are non-refundable except as required by law

4.3 AI Credits

AI-powered features consume credits based on your subscription plan. Credits are subject to daily, monthly, and burst limits as specified in your plan.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or servers
  • Reverse engineer, decompile, or disassemble the Services
  • Use automated systems (bots, scrapers) without permission
  • Share account credentials with unauthorized parties
  • Upload malicious code or content
  • Resell or redistribute the Services without authorization

6. Intellectual Property

6.1 Our Property

The Services, including all content, features, and functionality, are owned by CyberPolicify and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of data and content you upload. By using the Services, you grant us a license to use your content solely to provide and improve the Services.

6.3 Generated Content

AI-generated documents, assessments, and reports created through our Services are licensed to you for your internal business use. You may not resell generated content as a service.

7. AI-Generated Content Disclaimer

Our Services use artificial intelligence to generate compliance documents and recommendations. You acknowledge and agree that:

  • AI-generated content is provided for informational purposes and as a starting point
  • Generated content should be reviewed and customized by qualified professionals
  • CyberPolicify does not guarantee compliance with any specific framework or regulation
  • You are responsible for ensuring all policies and documents meet your legal and regulatory requirements
  • AI outputs may contain errors or inaccuracies that require human review

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERPOLICIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless CyberPolicify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination:

  • Your right to use the Services will immediately cease
  • You may request export of your data within 30 days
  • We may delete your data after a reasonable retention period
  • Provisions that should survive termination will remain in effect

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or the Services shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and CyberPolicify
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
  • Waiver: Our failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
